Are You Ready for the FLSA Changes on December 1st?  A practical review of what you need to do to be ready and stay compliant.  Michael Bennett – Managing Director, H3R Human Resources Services Inc.                             Clark Tew – Attorney, Homesley & Wingo Law Group PLLC
Michael and Clark will be providing an overview of the upcoming changes to the federal Fair Labor Standards Act (FLSA) with regard to salary levels required to classify employees exempt from overtime pay.  Specifically, two changes will be reviewed and discussed:  1) basic qualifying salary change from $23,660 to $47,476, and 2) highly-compensated individual exemption change from $100,000 to $134,004.  The discussion will also include options for adjusting affected employees and strategies for minimizing unplanned overtime expenses.
They will also be discussing the employee classification process, both 1099 contractor versus employee and exempt versus non-exempt employee, providing clarification on this area that many businesses get wrong, resulting in Department of Labor complaints and penalties.

Learning Objectives
Upon completion of this session, participants will be able to:

  • Identify whether their organization is covered by federal FLSA or NC DOL Wage and Hour Act;
  • Discuss the potential penalties of non-compliance with applicable wage and hour acts;
  • Assess whether 1099 Contractors are truly independent or should be classified as employees;
  • Describe the process for classifying employees as exempt or non-exempt;
  • Determine which FLSA exemption category their salaried employees may fall into;
  • Review their employees to determine which ones are affected by the overtime salary threshold change;
  • Discuss options for addressing employees affected by the salary threshold change to be compliant on December 1st;
  • Discuss potential strategies for minimizing overtime costs as a result of previously exempt employees now being overtime eligible within their organization.
